Electronic Commerce Protection Regulations for Canada

CASL

Effective July 1, 2014 Canada has new requirements for sending mass emails. Here is what you need to know about using ISN in accordance with Canada's Anti-Spam Legislation (CASL). This new legislation applies to everyone who sends electronic messages for commercial purposes, including individuals, incorporated and unincorporated businesses. Common commercial electronic messages (CEMs) include advertisements and information about promotions, offers, events, coupons, etc.

Under the new law, consent is required before sending a CEM. There are two types of consent:

  • First, Express consent means someone actively gave you permission to send the message.

  • Second, Implied consent means it would be reasonable to conclude you have someone's permission to send a CEM based on an existing relationship within the last two years.

How to comply using ISN:

First, you should create an email template to request your clients and agents to subscribe and provide consent for you to send emails. Here is an example template for your clients and agents:

Example email template for agents

Hello %buyersagentfirstname%:

In accordance with the Electronic Commerce Protection Regulations effective July 1, 2014, we need your expressed permission to continue sending you messages and information about our company. Please provide consent by subscribing to our email newsletters, emails and messages: %subscriberlink%.

Thank you, %company%

Second, create two mass emails: one mass email for your clients and one mass email for your agents. (This will allow you to replace their first names appropriately in the email.)

When you create for your mass email to request clients and agents to subscribe we will automatically unsubscribe all clients and agents from your mass email list. The automation will unsubscribe everyone who has not done business with you in the last two years (implied consent).

When the clients and agents click on the email they will see the following subscription information / page:
